Pool maintenance and seasonal services

All services are subject to a separate written contract agreed upon between Coastal Pools & Spas and the client prior to commencement of any work.

3. Use of the Website

You agree to use coastalpoolsny.com only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

5. Project Contracts and Payment

All pool construction, renovation, and installation projects require a separate, signed written contract before work begins. That contract will outline:

The full scope of work, materials, and specifications.
Project timeline and milestone schedule.
Total contract price and payment schedule.
Change order procedures for any modifications to the original scope.
Warranty terms applicable to the specific project.

Payment terms are as specified in the project contract. Late payments may be subject to interest charges as outlined in the contract. We reserve the right to suspend work on any project where payment obligations are not met.

6. Permits and Compliance

Coastal Pools & Spas will obtain all required building permits and ensure that all work is performed in compliance with applicable New York and Connecticut building codes, zoning regulations, and health and safety standards.

The client is responsible for ensuring that the property is accessible and that any homeowners association (HOA) approvals or deed restrictions are resolved prior to the commencement of work. Delays caused by permit issues outside our control or HOA restrictions are not the responsibility of Coastal Pools & Spas.

7. Warranties

Coastal Pools & Spas provides limited warranties on workmanship and installed equipment as specified in your individual project contract. General warranty terms include:

Structural Warranty — Coverage for structural defects in pool shell construction as outlined in the project contract.
Equipment Warranty — All installed equipment (pumps, heaters, filtration systems) carries the manufacturer’s warranty. We will assist with warranty claims during the first year after installation.
Workmanship Warranty — We stand behind the quality of our installation work as detailed in your signed contract.

Warranties do not cover damage caused by misuse, neglect, improper maintenance, acts of nature, freeze damage, chemical imbalance, or modifications made by third parties after project completion.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Coastal Pools & Spas shall not be liable for:

Any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services.
Any loss of profits, revenue, data, or business opportunity.
Damages resulting from circumstances beyond our reasonable control, including but not limited to acts of nature, extreme weather, utility disruptions, or material supply shortages.
Inaccuracies or errors in content published on our website.

Our total liability for any claim arising out of or relating to our services shall not exceed the total amount paid by the client under the applicable project contract.

Coastal Pools & Spas does not make credit decisions and is not responsible for the terms, rates, or decisions made by financing partners.

Approval for financing does not constitute a binding contract for services until a separate project contract is signed.

12. Cancellation and Termination

Cancellation of a signed project contract is subject to the cancellation terms outlined in that contract. In general:

Cancellations made before project commencement may be subject to a cancellation fee to cover design, permitting, and administrative costs already incurred.
Cancellations after project commencement will be subject to payment for all work completed and materials ordered up to the date of cancellation.
We reserve the right to terminate a project contract if the client fails to meet payment obligations or creates unsafe working conditions on site.

13. Governing Law

These Terms and Conditions and any disputes arising from them shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any legal action or proceeding arising from these Terms shall be brought exclusively in the courts located in Westchester County, New York.

14. Dispute Resolution

In the event of a dispute arising from our services or these Terms, both parties agree to first attempt to resolve the matter through good-faith negotiation. If negotiation is unsuccessful, disputes may be submitted to mediation before pursuing formal legal action. Nothing in this section prevents either party from seeking emergency injunctive relief where necessary.

15. Indemnification

You agree to indemnify, defend, and hold harmless Coastal Pools & Spas, its owners, employees, contractors, and agents from and against any claims, liabilities, damages, losses, or expenses — including reasonable legal fees — arising out of or in any way connected with your use of our website, your violation of these Terms, or any misrepresentation you make in connection with our services.
